In using Trade Find you accept and agree to these terms and conditions. If at anytime you do not agree to these terms and conditions you must refrain from using the Trade Find website.

Your continued use of the Trade Find website confirms that you agree to be bound by these terms and conditions.

1.0  Your Personal Profile

You agree that:

a) You are 18 years of age or older OR you have your parents consent.

b) You are resident in New Zealand.

2.0  Trade Find's Liability and Responsibility Explained

You clearly understand that:

a) Trade Find is not responsible for site content. Trade Find displays ads that its members SELF-CREATE by entering and uploading their OWN text and images into online templates or commission a Licensed Agency to create. Trade Find provides a Report Ad facility should any ad not be acceptable to a site user. 

b) You are using the Trade Find website at your own risk. You understand should anything happen to your advert/s or login, that no refunds whatsoever are possible under any circumstances. You understand that Trade Find is NOT a full-time managed website and by accepting our low price advertising that you are paying for one month's advertising only and we will do our best to give you 11 extra months free of charge. By accepting our low price advertising you are using our website at your own risk and you understand that no refund is available should a full 12 month display term not be met.

c) If a job or service is offered, promised or accepted following any activity on Trade Find, that any agreement of the activity offered, accepted or delivered is formed between the person advertising the service and the person accepting or proposing to accept the service, and that Trade Find takes no part whatsoever in any activities beyond displaying the advertiser's ad.

d) Trade Find Limited undertakes no reference checks on any of its members, advertisers or site users, nor does Trade Find Limited act as an agent for members, advertisers or website users, nor participate in any transactions or negotiations, nor take part in any work or contract negotiations, nor take fees, payments or commission for any work undertaken as a result of using the Trade Find website and because of this Trade Find Limited cannot guarantee the performance or standard of work or level of service of anyone advertising on the Trade Find website, guarantee the trustworthiness, authenticity or professionalism of anyone using the Trade Find website who is providing work promises, projects, jobs or contracts for fees, payment, commission, contra or other, nor provide any undertakings, representations or warranties in relation to services or jobs that are advertised, carried out or commissioned through using Trade Find, nor endorse or validate any website, podcast, video or other external application which is linked by our advertisers through their Trade Find ads.

e) No opportunity exists where any Trade Find website user can make a claim against Trade Find Limited or its representatives or hold Trade Find Limited or its representatives liable for any losses that may have occurred from any misconduct or unmet offers, expectations, promises, work or damages arising from any introduction or transaction that takes place as a result of using the Trade Find website, and under no circumstances can any legal proceedings be conducted against Trade Find's Directors, Agents, Employees or Contractors for any liability, damages, costs or expenses (including without limitation 'attorneys fees') arising out of any losses, proceedings, damages, liabilities or demands suffered or incurred as a result of using the Trade Find website, or failing to comply with these terms and conditions, or failing to deliver or pay for a job or service, arising out of any content that any Trade Find website user submits, pastes, posts, transmits or makes available before, during or after using the Trade Find website.

f) For your absolute protection and security Trade Find recommends that before any services are explored, accepted, confirmed or undertaken, to reduce risk of false or incompetent service pretences and fraud that full reference checks are carried out by the service user and the service provider. We highly recommend that no contract is entered into without a written memorandum of understanding between parties to avoid something unforeseen going wrong and that everyone using the Trade Find website undertakes reference checks.

g)  No opportunity exists where any Trade Find website user can make a claim against Trade Find Limited or its representatives or hold Trade Find Limited or its representatives liable for any losses occurred from false representation and that it is the Trade Find website users responsibility to check the validation of anyone posing to be a Trade Find representative.

h) All fees you pay to Trade Find for Trade Find ads, banners, promotions and/or services are non-refundable and non-transferable.

i) The Consumers Guarantees Act 1993 (www.consumeraffairs.govt.nz/consumerinfo/cga) does not apply to Trade Find website members or users.

j) It is your responsibility to declare all earnings over $200 per year (gross) to the Inland Revenue as taxable income. (www.ird.govt.nz/business-income-tax)

k)  Trade Find Limited may update or change these terms and conditions from time to time and the terms and conditions of any promotion or Contractors agreement at anytime, and it is your full responsibility to check for any updates. This current display of the Trade Find website Terms & Conditions was updated on July 03, 2009.

3.0  Website Housekeeping, Ad & Content Management and Good Practice

You agree you will:

a) Maintain an active working email address and keep your ad content and contact details current and updated, and ads complete in form and professional in appearance at all times.

b) Not use the Trade Find website under more than one login name, email address and/or identity unless approved by Trade Find.

c) Respond to ad inquiries in a timely and professional manner.

d) Not use any obscene, pornographic, defamatory or unlawful photos or information in your Ads or infringe upon any copyrights, trademarks or advertising codes of practice as set by the NZ Advertising Standards Authority Inc. (www.asa.co.nz).

e) Not display any contact details in the body of your Ad and expect to NOT be contacted. (Note: The Ad deactivation feature will only hide your contact details when they have been entered into the contact details fields provided).

f) Use the feedback feature on Trade Find to paste constructive comments that do not personally attack or directly slander a Trade Find advertiser. (Note: Feedback determined as unsuitable by Trade Find Limited will be deleted from the site once reported and members placing this type of feedback may be banned from using Trade Find).

g) Not use the Trade Find website to offer services which are of a speculative nature, including money making pyramid selling schemes.

You clearly understand that Trade Find Limited may at anytime:

h)  Remove an ad, issue a warning and/or suspend a Trade Find website user or delete an ad if it is deemed unsuitable for Trade Find at Trade Find Limited's discretion, or if any of these terms and conditions are breached, or when a matter of concern pending investigation is brought to the attention of Trade Find Limited or any of its representative's.

i) Move an Adult Entertainment, Escort Service or any ad that has been placed into an inappropriate service category into its correct category, and should you move it back or move it into another inappropriate position Trade Find Limited will delete your ad and no refund will apply.

j) Change, modify or merge service categories and/or change the website graphics, features and/or performance activity processes.

k) Change, increase or adjust the pricing or packaging of Trade Find ads, banners, and any advertising or promotional offer.

l) Use all or any component of any ad displaying on the Trade Find website including the advertisers name for Trade Find advertising, marketing and promotional purposes.

You also understand that:

m) Clicking on any link from a Trade Find ad, banner or promotion is done entirely at your own risk.

n) By advertising on Trade Find you are giving Trade Find or its representative permission to automatically send you newsletters and email's from time to time to remind you to keep your Ad/s fresh and updated. (Note: You can unsubscribe from receiving Trade Find emails and newsletters under 'Change Profile').

o) Trade Find does not offer any refunds or replacement ads or subsidies for ads that are removed or deleted purposefully or accidentally before their expiry term.

p)  The Trade Find system automatically notifies an ad owner by email as their ad approaches the end of its display term. Ad renewal is optional and no rollover conditions apply.

4.0   Website Access & Security:

Trade Find Limited:

a) Will make all reasonable attempts to provide a 24 X 7 operational website subject to any downtime required for site enhancements, modifications and maintenance, however does not, will not and cannot guarantee that the Trade Find website will be 100% operational without interruption or errors, or that it is secure or reliable, and Trade Find Limited will not take responsibility for any website or profile unavailability, or any losses occurred as a result of the Trade Find website being unavailable, or for any data corruption that may occur.

b)  Will fully respect user privacy and treat all information in the Trade Find database including personal membership and user details as strictly confidential.

c)  Will not allow third parties to access our members personal information unless Trade Find is required to do so by law during or following any legal proceedings.

d) Will continue to provide website user security through database encryption using SSL (Secure Socket Layer - 128 Bit Encryption).

e) Does not capture, hold or store any credit card information. (Note: All credit card payments and transactions are made through ANZ eGate and Eftpos New Zealand online banking systems over Secure Sockets Layer (SSL). For more information visit: www.anz.com/nz).

f) Will continue to list the names and contact detail of all Trade Find representatives on the Trade Find website 'Support Centre' page for your security.

You agree you will not:

g) Infect or allow the infection of the Trade Find website with any form of worm, virus, tracker or other, or perform any activities that may harm the Trade Find website or the reputation of Trade Find Limited or any of its representatives.

 

5.0   Payment Terms

You agree you will:

a) Pay for your Trade Find Ad/s at point-of-purchase using the Paypal Payment and credit card facility provided or you will select to generate an email invoice and you will make payment as per the instructions stated on the invoice, which includes: 

• Paying the full amount due within 7 days of the invoice request.
• Entering the SA-N number 'as stated on your invoice' into the online banking reference field for payment recognition, or writing the SA-N number onto the back of your cheque, if paying by cheque.

You fully understand that:

b) Trade Find Limited will charge you a $25 + GST (minimum) administration fee should we be asked to search for and identify your payment in situations where you have not advised us of the SA-N Ad payment number reference when making your payment, and that we may ask you to make your payment again if it cannot be identified or traced easily.

c) You will be liable for covering ALL additional and associated costs if we have to appoint a Debt Collection Agency to collect your payment.

 

6.0   Trade Find Intellectual Property Rights, Trademarks & Copyrights:

Trade Find Limited owns all intellectual property rights, trademarks and copyrights for the Trade Find brand and website (including all website graphics and design and performance processes) and all software, documentation and services that form and support the Trade Find website.

a) No one is permitted to copy, reproduce, duplicate, publish, or on-sell any part of the Trade Find website without full written approval from Trade Find Limited.

These terms and conditions are governed by the laws of New Zealand. They supersede and replace all previous terms and conditions which may have been previously displaying on the Trade Find website, or may have been printed or otherwise distributed and constitutes the entire agreement between Trade Find website users and Trade Find Limited. Interpretation of these terms and conditions and termination of an advertisement is at the sole discretion of Trade Find Limited; its Directors, Agents, Employees and Contractors.
